Nyx Resonance Inc. ("we," "us," "our") is a federally incorporated Canadian company operating the Nyx Resonance live audio streaming platform, which includes the Nyx Player mobile application and the Nyx Console operator application (collectively, "Services"). This Privacy Policy describes how we collect, use, disclose, and protect personal information in connection with our Services. It applies to all users: Listeners (Nyx Player) and Hosts (Nyx Console). This policy complies with:

3.1 Account Information When you create an account, we collect: name, email address, and password (hashed). Hosts may also provide business name and billing information processed by Stripe (our payment processor).
3.2 Device and Technical Information When you use the App or Console: device identifiers, operating system version, IP address (truncated after session), and app version. This data is used for authentication, security, and service delivery.
The App generates a random identifier for your device the first time it runs, and sends it when you join or leave an event so the event knows how many devices are connected. It is not your advertising ID and is not linked to any identifier assigned by Apple or Google. It is stored on your device and is erased when you uninstall the App.
3.3 Session Metadata For each audio session: session ID, join/leave timestamps, channel selections, and connection quality metrics. We do not store the audio content of sessions.
3.4 Audio Content Live audio travels over the event's own local network, directly from the operator's console to the phones in the room. It is processed in real time for transmission only, is never recorded, and is not stored on any of our servers. Audio does not pass through our infrastructure or over the internet at all.
3.5 Push Notification Consent Records If you opt in to push notifications, we retain a record of your consent including the date, time, and method of consent, as required by CASL.
3.6 Voice Data and Biometric Information We do not collect, store, or process voice data for identification, biometric profiling, or any purpose other than real-time audio delivery. Under the CCPA/CPRA, live audio may constitute Sensitive Personal Information (SPI) if it contains voice data. We do not use your audio for advertising targeting, profiling, or any secondary purpose. California residents have the right to limit the use and disclosure of SPI; see Section 9.
3.7 Microphone and Camera Both are used only when you choose a feature that needs them, and neither runs in the background.
The microphone is used during optional headphone calibration, to measure how long your phone and headphones take to produce sound. The recording is analysed on your device and is never uploaded, stored or listened to by us. What leaves your device is the measurement described in Section 3.8.
The camera is used only to scan an event QR code, a feature offered to event operators. Images are not stored or uploaded.
3.8 Calibration Measurements If you run calibration, the App uploads the measurement so other people on the same hardware get better audio timing. Each measurement contains: the measured latency values, your phone model, operating system version, App version, the headphone or earbud model reported by the operating system, the audio route and codec in use, and the event it was taken at. It also contains the random device identifier from Section 3.2.
Calibration is optional, and the App works without it. These measurements describe hardware, not people: we use them to build a table of latency by device model, and we do not use them to identify you or to target advertising.
We use personal information to:
(a) Create and manage your account and authenticate your identity; (b) Deliver audio sessions to Listeners and enable Hosts to broadcast; (c) Process Host subscription payments through Stripe; (d) Send transactional messages (account confirmations, session notifications); (e) Send commercial electronic messages where you have provided express consent (CASL); (f) Maintain security, detect fraud, and enforce our Terms of Service; (g) Improve our Services through aggregate, anonymized analytics; (h) Comply with legal obligations.
We do not sell your personal information. We do not use your information for targeted advertising.
Under PIPEDA and Quebec Law 25, we rely on your consent (express or implied) and our legitimate business interests as the basis for processing. For Quebec users, we rely on explicit opt-in consent for any profiling or tracking features. Under Law 25 Section 9.1, our Services default to the highest privacy settings.
If we use automated processes to match users, moderate sessions, or personalize features, we will disclose this in this policy and in the applicable feature interface, as required by Quebec Law 25. As of the date of this policy, we do not make automated decisions that produce legal effects concerning users. Users in Quebec have the right to request human review of any automated decision that significantly affects them.
You may request deletion of your personal information, subject to legal retention obligations, by contacting our Privacy Officer. Step-by-step instructions, and what is deleted or kept, are at https://nyxresonance.com/delete-account.
Our Services run on infrastructure that includes servers in the United States operated by Cloudflare, Inc. By using our Services, you acknowledge that your personal information may be transferred to and processed in the United States.
The United States has different privacy laws than Canada. In particular, the US CLOUD Act (Clarifying Lawful Overseas Use of Data Act) and other US laws may permit US government authorities to access data held by US-based service providers, including Cloudflare. We maintain contractual safeguards with our US infrastructure providers requiring them to protect your data to a standard comparable to Canadian requirements, as required by PIPEDA.
California users: this transfer is disclosed as required by CCPA Section 1798.100.
Canadian users (all provinces) have the right to: access personal information we hold about you; request correction of inaccurate information; withdraw consent (subject to legal or contractual restrictions); file a complaint with the Office of the Privacy Commissioner of Canada (OPC).
Quebec users additionally have the right to: data portability (receive your data in a structured format); object to profiling; request human review of automated decisions; file a complaint with the Commission d'accès à l'information (CAI). Response time: 30 days from receipt of your request.
California residents have the right to: know what personal information is collected, used, and disclosed; delete personal information (subject to exceptions); opt out of sale (we do not sell personal information); limit use and disclosure of Sensitive Personal Information, including voice data; non-discrimination for exercising privacy rights. Virginia and Colorado residents have the right to: access, correct, and delete personal information; data portability; opt out of profiling for decisions with legal or significant effects; appeal our response to a rights request. Contact support@nyxresonance.com to exercise these rights.
To exercise any privacy right, contact our Privacy Officer. We will respond within 30 days (Quebec / PIPEDA) or 45 days (US state laws).
Our Services are not directed to children under 13. We do not knowingly collect personal information, including voice data, from children under 13. Under the Children's Online Privacy Protection Act (COPPA) and the FTC's updated regulations, voice data constitutes biometric information and personal information requiring Verifiable Parental Consent (VPC) before collection from users under 13. If we learn that we have collected information from a child under 13, we will delete it immediately. Report suspected under-13 users to support@nyxresonance.com.
We send two types of electronic messages:
Transactional messages (account confirmations, session notifications, security alerts): sent without separate consent as they are necessary to provide the Service.
Commercial messages (product updates, feature announcements, promotional offers): sent only with your express or implied consent under CASL. Each commercial message includes a clear unsubscribe mechanism. You may unsubscribe at any time. The unsubscribe mechanism will remain functional for at least 60 days after the last commercial message. We identify ourselves as the sender in every message.
We implement reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, and destruction. Live audio travels only over the event's own local network and never through our servers, and is always encrypted in transit with SRTP (AES-128). Account credentials are hashed and salted. We do not store raw passwords.
No transmission over the internet is fully secure. We cannot guarantee absolute security.
In the event of a data breach that poses a real risk of significant harm to individuals, we will notify the OPC (federally) and the CAI (Quebec) as required by PIPEDA and Law 25. We will also notify affected individuals without undue delay. Our Privacy Policy will be updated as required following any notifiable breach.
We will post material changes to this policy at least 30 days before they take effect, and notify registered users by email or in-app notice. Your continued use of the Services constitutes acceptance of the updated policy.
